Terms and Conditions

1. General Information

The NIH 3D Print Exchange digital platform (“the Exchange”) is provided without charge to the research community to be a trusted digital repository of digital 3D model files that are readily compatible with 3D printers. The Exchange is operated by the National Institutes of Health (NIH), an agency of the U.S. Department of Health and Human Services (DHHS). The Exchange has provided Terms and Conditions for use of the service (“Terms and Conditions”) in order to establish guidelines for responsible usage, to protect the rights of content owners, and to facilitate the archiving and dissemination of high-quality content for the long-term benefit of the user community. These Terms and Conditions will apply to your use of the Exchange and by using the Exchange, you are agreeing to these Terms and Conditions of Service.

2. User Accounts

2.1 General Information. Access to content on the Exchange is available for viewing and download by all persons (“Users”).

2.2 Authorized Users. In order to use certain features of the Exchange (e.g., to upload a model, create a model, or post comments), you must register for an account and provide certain information about yourself as requested in the registration process. In doing so, you become an “Authorized User” and warrant that (a) all required information you submit is truthful and accurate; and (b) you will maintain the accuracy of such information. Accounts may be deleted at any time, but content you have uploaded to the Exchange will remain unless you request that it be removed. To request removal of content, please contact us.

2.3 User Responsibilities. You are responsible for maintaining the confidentiality and security of your username and/or password if you have one, and for all usage or activity by them on the Exchange. You promptly shall notify the Exchange of any known or suspected unauthorized use(s) of your account or any known or suspected breach of security, including loss, theft, or unauthorized disclosure or use of your username or password. Any use of the Exchange beyond the scope or in violation of these Terms and Conditions, knowing use of any password or username of another, or any fraudulent, abusive, or otherwise illegal activity, may be grounds for termination of your account. You acknowledge and agree that any material that you submit or comment that you post may be edited, removed, and/or modified by the Exchange without notice.

2.4 User Contributed Models. Where you are able to submit material and/or post comments to the Exchange, you represent and warrant that you will not submit any protected health information or personal identifiers in any material and will de-identify any image files or contributed information furthermore you will not upload or otherwise publish through the Exchange any materials that: (a) are protected by copyright, or other proprietary or intellectual property rights of which you are not the owner; (b) are libelous, defamatory, obscene, pornographic, abusive, or invasive of another’s privacy or hateful; or (c) contain a virus, spyware, or other harmful component, advertising of any kind, or false or misleading indications of origin or statements of fact. You will not attempt to establish the identity of any persons that have image information or other information on this site. You agree to indemnify and hold the NIH harmless from any and all liability and costs incurred in connection with any claim arising out of your breach of the foregoing representations and warranties. You will cooperate as fully as reasonably required in the defense of any claim.

3. Intellectual Property.

3.1 General Intellectual Property Rights. The NIH 3D Print Exchange trademarks, rights in ideas, designs, works of authorship, derivative works, and all other intellectual property rights (collectively, "Intellectual Property") relating to the NIH 3D Print Exchange framework and software should not be used without prior permission from NIH.

3.2 Name, Logos, and Trademarks. Neither Users nor the Exchange may use the other's name, logo or trademark and may not use the name, logos or trademarks of the above-noted DHHS, NIH, or any of its component Institutions in a way likely to cause confusion as to the origin of goods or services, or to endorse or show affiliation with the other, except as specifically approved. The Exchange may use User-contributed content for promotional material, events, or publications, within the limits of the license applied to the content by the user. The Exchange will not use the User's name or image without prior consent, except as to provide attribution for content, as specified within the terms of the content license.

4. Liability.

4.1 General Waiver of Liability. The DHHS and the NIH are not liable for damages resulting from 3D printed models generated from files hosted on the Exchange. Users may provide suggested materials or instructions for printing 3D files, however you maintain responsibility for proper printing and usage of such models.

4.2 Anatomical and Medical-Related Models. The 3D models in our database are not intended to diagnose, prevent, or treat any medical condition in any way. Prints of 3D anatomical models on the Exchange should not be used for medical purposes. They should be used solely for illustrative purposes.

4.3 Laboratory Equipment. Users may share laboratory equipment, accessories, and other devices to facilitate research practices, but may require specific materials or print specifications to withstand particular laboratory environments. If you choose to download and print such User-contributed models, you are responsible for the proper printing, handling, and implementation of such models. Neither the Exchange, nor the content owner, are liable for any damage to existing equipment or supplies, including research materials and outcomes, that may arise from using such prints, even when built according to instructions provided by the content owner.

4.4 Data-derived Molecular and Volumetric Models. 3D prints generated from files in the Exchange are intended to facilitate scientific discovery and learning. You are responsible for independently confirming results or hypotheses based on 3D printed files.

4.5 Custom User-Designed Content. The Exchange intends to moderate User-contributed content for scientific relevance and accuracy and reserves the right to remove material that does not meet specified criteria or quality standards. Custom, 3D illustrations of medical or scientific structures may be difficult to verify for accuracy, but regardless can be valuable for visualization purposes.

5. "NIH Verified" Content

5.1 Criteria. The Exchange may designate particular models, either those generated from the "quick submit" pipelines, or from our own 3D modeling specialists, as "NIH Verified," as indicated with an icon on the model description page. We may also mark other content as "NIH Verified" if it has been evaluated for scientific accuracy by our team.

5.2 Purpose. The "NIH Verified" seal is not intended to present a bias for or against use of any particular models on the Exchange; rather, the seal is intended to provide to the User community an indication of a higher level of confidence in the scientific accuracy of a 3D model.

5.3 Application or Removal of "Verified" Status.. The Exchange reserves the right to add or remove the "NIH Verified" seal from a model at any time, for any reason, and without notice to the content owner or the User community.
